About the Defective Design of 3M Earplugs
Between 2003 and 2015, military members deployed to Iraq and Afghanistan were issued 3M’s dual-ended CAEv2. The earplugs were designed to offer two levels of hearing protection: If one end was inserted into the ear, all noise was blocked; if the other end was inserted, high-level sounds were blocked while low-level sounds like voices could be heard.
Unfortunately, because of a flawed design, the earplugs did not work as intended. The stems were too short to be properly inserted into the ear, and they could slip out unbeknownst to the soldier, exposing them to harsh combat noises that damaged the ear.
3M Paid $9.1 Million to Settle Lawsuit Allegations
In 2016, a lawsuit was filed against 3M, claiming that the company and its predecessor, Aearo Technologies, Inc., knew the earplugs were defective but did not disclose this information to the Defense Logistics Agency before selling the earplugs to the agency. 3M paid $9.1 million to settle the allegations, but it did not admit liability for the defective design.
